Agreement to Terms

These Terms of Service (“Terms”) govern the rental of restroom trailer equipment from LEI Capital Inc dba Lux Dumps (“Lux Dumps,” “Company,” “Lessor”) to the client (“Customer,” “Lessee”). By placing a deposit or signing a rental agreement, you agree to be bound by these Terms.

Services

Lux Dumps provides luxury restroom trailer rentals for events throughout Southern California. All rentals are for a 24-hour period unless otherwise agreed in writing. Lux Dumps reserves the right to make equipment substitutions of equal or better quality and may subcontract some or all services when necessary.

Delivery, Setup & Pickup

Delivery will be scheduled at least 5 days before the date of the event. Delivery is typically the Thursday or Friday before your event; however, in some cases delivery may occur the morning of your event. The trailer must be removed on the pickup date noted in your agreement.

If the trailer is needed for the day before or day after the event date, an additional fee may apply. Lux Dumps must be notified in advance to confirm availability and capacity.

On delivery, the Customer will inspect the equipment and confirm it is in good condition, appropriate for their needs, and clean.

Customer Site Requirements

The Customer is responsible for providing and ensuring the following at the installation site:

Water: Access to a garden hose water hook-up within 100 feet of the trailer location, unless an onboard water tank is included in your package.
Power: Access to a main power source (20amp, 120v outlet) within 50 feet of the trailer. Exceptions up to 100 feet will be assessed on-site if feasible. If power requirements cannot be met, a generator must be supplied (minimum 3,000 watts dedicated to the trailer).
Ground conditions: Easy site access, firm and level ground, and a dry location. Trailers are inoperable on inclines. Lux Dumps may deem a location unacceptable.

Lux Dumps is not responsible for lawn or ground damage from the truck or trailer.

Supplies Included

Lux Dumps will provide the following supplies per stall for each rental:

Toilet Paper (6 rolls)
Hand Sanitizer
Mouthwash
Paper Towels
Hand Soap

Payment Terms

A deposit of $500 is due at the time of reservation. The remaining balance is due 30 days prior to the delivery date of the trailer. Unpaid or overdue balances may result in cancellation of the reservation.

Payment will be made to Lux Dumps via cash, an approved payment card, or any other payment method approved by Lux Dumps.

Cancellation Policy

The $500 initial deposit is non-refundable. Cancellation refunds beyond the non-refundable deposit are determined by the following schedule based on notice provided before the event date:

91 to 120 days or more notice: Deposit minus $100 refunded, OR 100% of total deposit applied to a new date
61 to 90 days notice: Deposit minus $200 refunded, OR 100% of total deposit applied to a new date
31 to 60 days notice: 0% refund of deposit, OR 75% of total deposit applied to a new date
0 to 30 days notice: 0% refund of deposit — no exceptions

Customer Responsibilities

The Customer agrees to the following during the rental period:

Make no attachments or alterations to the equipment. Do not attach, duct tape, lean equipment, or place tents where damage could occur.
Not cause any damage (or allow any damage by guests) to any portion of the unit. At the end of the rental, return the equipment in good condition, ordinary wear and tear excepted.
Not move the trailer from the setup location. If the trailer must be moved, a fuel and time charge will apply.
Not assign this agreement or transfer possession or control of the equipment without written consent from Lux Dumps.

The Customer chooses the installation site and accepts all responsibility in connection with that choice of location.

Damage & Loss Policy

A credit card must be provided by the Customer to cover any potential damages to equipment or loss of items, both inside and outside of the unit. The Customer agrees to allow charges for necessary repairs or replacements to be made to the provided credit card. This includes but is not limited to damages caused by misuse, neglect, or intentional harm.

The Lessee is responsible for the cost of replacement and repairs due to fire, theft, carelessness, accidental damage, vandalism, or riot, and agrees to return equipment in the delivered condition (ordinary use and wear accepted).

Lux Dumps will provide a detailed invoice outlining the nature of any damage and associated costs prior to processing any charge. The Customer is responsible for promptly reporting any damages or missing items. Failure to report may result in additional charges or penalties.

Prohibited Uses

The Customer will not use the equipment for any unlawful purpose, allow unauthorized persons to operate or modify it, sublet or transfer the equipment to any third party, or use the equipment outside the scope of the agreed rental event.

Indemnification

The Customer agrees to indemnify and hold Lux Dumps and LEI Capital harmless from any and all claims or suits for bodily injury and/or property damage arising out of the use of the equipment. Upon delivery to the Customer, the equipment has passed out of the control of Lux Dumps and control is assumed by the Customer.

Limitation of Liability

Lux Dumps liability is limited to the value of services rendered under the rental agreement. Lux Dumps is not liable for indirect, incidental, or consequential damages arising from the use of the equipment.

Force Majeure

Lux Dumps shall not be liable for any damages if compliance with this agreement becomes impossible due to natural disaster, fire, flood, act of God, act of terrorism, weather, strikes, shortage of materials, or any other cause beyond its reasonable control.

Modifications to Terms

Any changes to a rental agreement must be agreed upon in writing by both the Customer and Lux Dumps. Lux Dumps reserves the right to update these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of the State of California. Any disputes arising under these Terms shall be resolved in the courts of Riverside County, California.
